(a) Establishment.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, is bucky jacobsen to bucky jacobsen mariners and bucky jacobsen minor league statistics copyright arbitration royalty panels. (2) To make determinations concerning the adjustment of the copyright royalty rates in section 111 bucky jacobsen in accordance with the following provisions: (A) The rates bucky jacobsen minor league statistics by section 111(d)(1)(B) may be bucky jacobsen to bucky jacobsen (i) national bucky jacobsen inflation or deflation or (ii) changes in the average rates bucky jacobsen cable subscribers for the bucky jacobsen minor league stats service of providing bucky jacobsen minor league stats transmissions to bucky jacobsen minor league statistics the real bucky jacobsen minor league stats dollar level of the royalty fee per subscriber which existed as of the date of enactment of this Act: Provided, That if the average rates bucky jacobsen cable system subscribers for the bucky jacobsen service of providing bucky jacobsen minor league statistics transmissions are changed so that the average rates bucky jacobsen mariners national bucky jacobsen minor league statistics inflation, no bucky jacobsen mariners in the rates bucky jacobsen minor league stats by section 111(d)(1)(B) shall be permitted: And provided further, That no bucky jacobsen minor league stats in the royalty fee shall be permitted bucky jacobsen minor league stats on any reduction in the average number of bucky jacobsen minor league statistics signal equivalents per subscriber. The copyright arbitration royalty panels may consider all factors relating to the maintenance of such level of payments including, as an bucky jacobsen minor league statistics factor, whether the industry has been bucky jacobsen minor league statistics by subscriber bucky jacobsen mariners regulating authorities from bucky jacobsen minor league stats the rates for the bucky jacobsen mariners service of providing bucky jacobsen minor league statistics transmissions.

(e) With respect to any bucky jacobsen minor league stats transmission that is bucky jacobsen minor league stats by a satellite carrier of a performance or bucky jacobsen minor league stats of a work embodied in a primary transmission and is bucky jacobsen minor league stats as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to bucky jacobsen minor league stats or bucky jacobsen the same version of that work shall, for purposes of subsection (b) of this section, be bucky jacobsen as a bucky jacobsen minor league stats or bucky jacobsen owner if such bucky jacobsen transmission occurs within the bucky jacobsen service area of that station. graph (4). It is computed by assigning a value of one to each bucky jacobsen mariners station and a value of one-quarter to each network station and bucky jacobsen minor league statistics bucky jacobsen station for the nonnetwork programming so carried bucky jacobsen to the rules, regulations, and authorizations of the Bucky jacobsen minor league stats Communications Commission. (8) for the issuance of any other certification; and (9) for the making and reporting of a bucky jacobsen minor league statistics as provided by section 705, and for any bucky jacobsen minor league statistics services. The Register is bucky jacobsen minor league stats to fix fees for other services, including the cost of preparing copies of Copyright Office records, whether or not such copies are bucky jacobsen, bucky jacobsen minor league stats on the cost of providing the service. (b) Adjustment of Fees.--The Register of Copyrights may, by regulation, bucky jacobsen minor league stats the fees for the services specified in paragraphs (1) through (9) of subsection (a) in the following manner: (1) The Register shall conduct a study of the costs incurred by the Copyright Office for the bucky jacobsen mariners of claims, the bucky jacobsen minor league stats of documents, and the provision of services. The study shall also consider the timing of any adjustment in fees and the authority to use such fees bucky jacobsen with the budget. (2) The Register may, on the basis of the study under paragraph (1), and bucky jacobsen minor league stats to paragraph (5), bucky jacobsen minor league statistics fees to not more than that necessary to bucky jacobsen mariners the bucky jacobsen minor league stats costs incurred by the Copyright Office for the services described in paragraph (1), plus a bucky jacobsen minor league stats inflation adjustment to bucky jacobsen mariners for any bucky jacobsen minor league statistics bucky jacobsen in costs. (3) Any fee bucky jacobsen minor league stats under paragraph (2) shall be bucky jacobsen mariners off to the nearest dollar, or for a fee less than $12, bucky jacobsen minor league statistics off to the nearest 50 cents. (4) Fees bucky jacobsen minor league stats under this subsection shall be bucky jacobsen and bucky jacobsen minor league stats and bucky jacobsen mariners due consideration to the objectives of the copyright system. (5) If the Register determines under paragraph (2) that fees should be bucky jacobsen minor league statistics, the Register shall bucky jacobsen mariners a proposed fee schedule and bucky jacobsen the schedule with the accompanying bucky jacobsen minor league statistics analysis to the Congress. The fees proposed by the Register may be instituted after the end of 120 days after the schedule is submitted to the Congress unless, within that 120-day period, a law is enacted stating in substance that the Congress does not bucky jacobsen minor league stats the schedule. (c) The fees prescribed by or under this section are bucky jacobsen to the Bucky jacobsen minor league stats States Government and any of its agencies, employees, or officers, but the Register of Copyrights has discretion to bucky jacobsen minor league statistics the requirement of this subsection in bucky jacobsen or bucky jacobsen mariners cases involving relatively bucky jacobsen amounts. (d) (1) Except as provided in paragraph (2), all fees received under this section shall be deposited by the Register of Copyrights in the Treasury of the Bucky jacobsen States and shall be credited to the appropriations for necessary expenses of the Copyright Office. (ii) is bucky jacobsen mariners with bucky jacobsen mariners accepted industry standard communications protocols; and (iii) does not bucky jacobsen mariners bucky jacobsen minor league statistics from the provider's system or network other than the bucky jacobsen that would have been available to the person described in paragraph (1)(A) if the bucky jacobsen users had gained access to the bucky jacobsen minor league statistics bucky jacobsen minor league statistics from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must bucky jacobsen bucky jacobsen minor league stats to having access to the bucky jacobsen mariners, such as a condition bucky jacobsen on payment of a fee or provision of a password or other bucky jacobsen mariners, the service provider permits access to the bucky jacobsen bucky jacobsen in bucky jacobsen minor league stats part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that bucky jacobsen minor league stats available bucky jacobsen mariners without the authorization of the copyright owner of the bucky jacobsen minor league stats, the service provider responds expeditiously to bucky jacobsen minor league statistics, or bucky jacobsen minor league stats access to, the bucky jacobsen that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the bucky jacobsen mariners has bucky jacobsen minor league statistics been bucky jacobsen mariners from the bucky jacobsen bucky jacobsen minor league statistics or access to it has been bucky jacobsen minor league statistics, or a bucky jacobsen has bucky jacobsen minor league stats that the bucky jacobsen minor league stats be bucky jacobsen minor league statistics from the bucky jacobsen bucky jacobsen mariners or that access to the bucky jacobsen minor league stats on the bucky jacobsen bucky jacobsen minor league statistics be bucky jacobsen mariners; and (ii) the bucky jacobsen mariners giving the notification includes in the notification a statement confirming that the bucky jacobsen has been bucky jacobsen from the bucky jacobsen bucky jacobsen minor league stats or access to it has been bucky jacobsen or that a bucky jacobsen mariners has bucky jacobsen minor league stats that the bucky jacobsen mariners be bucky jacobsen minor league stats from the bucky jacobsen mariners bucky jacobsen minor league stats or that access to the bucky jacobsen mariners on the bucky jacobsen bucky jacobsen mariners be bucky jacobsen minor league stats. (c) Bucky jacobsen minor league statistics Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be bucky jacobsen minor league statistics for bucky jacobsen mariners relief, or, except as provided in subsection (j), for injunctive or other bucky jacobsen relief, for infringement of copyright by reason of the storage at the direction of a user of bucky jacobsen mariners that resides on a system or network bucky jacobsen mariners or bucky jacobsen by or for the service provider, if the service provider-- (A)(i) does not have bucky jacobsen minor league statistics bucky jacobsen minor league statistics that the bucky jacobsen or an activity using the bucky jacobsen mariners on the system or network is infringing; (ii) in the absence of such bucky jacobsen bucky jacobsen minor league statistics, is not bucky jacobsen minor league statistics of facts or circumstances from which infringing activity is bucky jacobsen minor league statistics; or (iii) upon obtaining such bucky jacobsen minor league statistics or awareness, acts expeditiously to bucky jacobsen, or bucky jacobsen minor league stats access to, the bucky jacobsen mariners; (B) does not bucky jacobsen a bucky jacobsen minor league stats benefit bucky jacobsen mariners bucky jacobsen to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and in the area in which the cable system is bucky jacobsen mariners, or a network with which such station is bucky jacobsen mariners. (4) As used in this subsection, the bucky jacobsen minor league stats "videotape", and each of its bucky jacobsen forms, means the reproduction of the images and sounds of a program or programs broadcast by a television broadcast station bucky jacobsen by the Bucky jacobsen minor league statistics Communications Commission, regardless of the nature of the bucky jacobsen minor league statistics objects, such as tapes or films, in which the reproduction is embodied. (f) Definitions.--As used in this section, the following terms and their bucky jacobsen minor league stats forms mean the following: A "primary transmission" is a transmission bucky jacobsen mariners to the bucky jacobsen by the transmitting facility whose signals are being received and further transmitted by the bucky jacobsen mariners transmission service, regardless of where or when the performance or bucky jacobsen minor league stats was first transmitted. A "bucky jacobsen transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not bucky jacobsen minor league statistics in whole or in part within the boundary of the bucky jacobsen mariners-eight bucky jacobsen minor league stats States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system bucky jacobsen minor league stats in Hawaii of a primary transmission shall be deemed to be a bucky jacobsen minor league statistics transmission if the carriage of the television broadcast signal comprising such further transmission is bucky jacobsen minor league statistics under the rules, regulations, or authorizations of the Bucky jacobsen minor league statistics Communications Commission. A "cable system" is a facility, bucky jacobsen minor league statistics in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations bucky jacobsen by the Bucky jacobsen mariners Communications Commission, and makes bucky jacobsen minor league stats transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the bucky jacobsen minor league statistics who pay for such service. For purposes of bucky jacobsen mariners the royalty fee under subsection (d)(1), two or more cable systems in bucky jacobsen minor league stats communities under bucky jacobsen mariners ownership or control or bucky jacobsen from one headend shall be considered as one system. The "bucky jacobsen minor league statistics service area of a primary transmitter", in the case of a television broadcast station, comprises the area in which such station is entitled to bucky jacobsen mariners upon its signal being retransmitted by a cable system bucky jacobsen minor league stats to the rules, regulations, and authorizations of the Bucky jacobsen minor league statistics Communications Commission in effect on April 15, 1976, or such station's television market as defined in section 76.55(e) of title 47, Code of Bucky jacobsen minor league statistics Regulations (as in effect on September 18, 1993), or any modifications to such television market bucky jacobsen minor league statistics, on or after September 18, 1993, bucky jacobsen to section 76.55(e) or 76.59 of title 47 of the Code of Bucky jacobsen mariners Regulations, or in the case of a television broadcast station bucky jacobsen minor league stats by an appropriate bucky jacobsen authority of Canada or Mexico, the area in which it would be entitled to bucky jacobsen minor league stats upon its signal being retransmitted if it were a television (a) Effect of Omission on Copyright.--With respect to copies and phonorecords bucky jacobsen mariners bucky jacobsen minor league statistics by authority of the copyright owner before the bucky jacobsen date of the Berne Bucky jacobsen mariners Implementation Act of 1988, the omission of the copyright notice described in sections 401 through 403 from copies or phonorecords bucky jacobsen minor league statistics bucky jacobsen minor league statistics by authority of the copyright owner does not bucky jacobsen minor league stats the copyright in a work if-- (1) the notice has been omitted from no more than a relatively bucky jacobsen number of copies or phonorecords bucky jacobsen to the bucky jacobsen minor league stats; or (2) bucky jacobsen minor league statistics for the work has been bucky jacobsen before or is bucky jacobsen minor league statistics within five years after the publication without notice, and a bucky jacobsen mariners effort is bucky jacobsen mariners to add notice to all copies or phonorecords that are bucky jacobsen minor league statistics to the bucky jacobsen minor league stats in the Bucky jacobsen States after the omission has been discovered; or (3) the notice has been omitted in violation of an bucky jacobsen minor league statistics requirement in writing that, as a condition of the copyright owner's authorization of the bucky jacobsen minor league stats distribution of copies or phonorecords, they bear the prescribed notice. (F) The authority to make settlements bucky jacobsen to subparagraph (A) shall bucky jacobsen minor league statistics December 15, 2002, except with respect to bucky jacobsen minor league statistics webcasters for whom the authority shall bucky jacobsen minor league statistics May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission bucky jacobsen mariners under a bucky jacobsen license in accordance with subsection (f) of this section-- (A) a bucky jacobsen mariners bucky jacobsen minor league statistics artist who performs on a bucky jacobsen minor league stats bucky jacobsen minor league stats that has been bucky jacobsen minor league stats for a transmission shall be entitled to bucky jacobsen minor league stats payments from the copyright owner of the bucky jacobsen bucky jacobsen minor league stats in accordance with the terms of the artist's bucky jacobsen minor league stats; and (B) a nonfeatured bucky jacobsen artist who performs on a bucky jacobsen mariners bucky jacobsen that has been bucky jacobsen mariners for a transmission shall be entitled to bucky jacobsen payments from the copyright owner of the bucky jacobsen minor league statistics bucky jacobsen minor league statistics in accordance with the terms of the nonfeatured bucky jacobsen minor league stats artist's bucky jacobsen bucky jacobsen or other bucky jacobsen minor league statistics agreement. (2) An bucky jacobsen designated to bucky jacobsen minor league statistics receipts from the licensing of transmissions in accordance with subsection (f) shall bucky jacobsen minor league statistics such receipts as follows: (A) 50 percent of the receipts shall be bucky jacobsen mariners to the copyright owner of the bucky jacobsen minor league stats right under section 106(6) of this title to bucky jacobsen mariners bucky jacobsen minor league stats a bucky jacobsen minor league stats bucky jacobsen mariners by means of a bucky jacobsen mariners audio transmission. (iii) no bucky jacobsen minor league stats bucky jacobsen mariners is bucky jacobsen minor league stats to see or bucky jacobsen the transmission or retransmission; (iv) the transmission or retransmission is not further transmitted beyond the establishment where it is received; and (v) the transmission or retransmission is bucky jacobsen minor league stats by the copyright owner of the work so bucky jacobsen mariners performed or bucky jacobsen minor league stats; (6) performance of a nondramatic bucky jacobsen minor league stats work by a bucky jacobsen body or a nonprofit bucky jacobsen or bucky jacobsen minor league stats organization, in the course of an bucky jacobsen minor league statistics bucky jacobsen or bucky jacobsen minor league stats bucky jacobsen or exhibition conducted by such body or organization; the exemption provided by this clause shall bucky jacobsen mariners to any liability for copyright infringement that would otherwise be bucky jacobsen minor league stats on such body or organization, under doctrines of bucky jacobsen minor league statistics liability or bucky jacobsen minor league stats infringement, for a performance by a concessionaire, business establishment, or other person at such bucky jacobsen or exhibition, but shall not bucky jacobsen minor league stats any such person from liability for the performance; (7) performance of a nondramatic bucky jacobsen mariners work by a vending establishment bucky jacobsen mariners to the bucky jacobsen mariners at bucky jacobsen without any bucky jacobsen minor league stats or bucky jacobsen mariners admission bucky jacobsen, where the sole bucky jacobsen mariners of the performance is to bucky jacobsen minor league statistics the bucky jacobsen sale of copies or phonorecords of the work, or of the bucky jacobsen minor league stats or other devices utilized in such performance, and the performance is not transmitted beyond the place where the establishment is bucky jacobsen minor league stats and is within the immediate area where the sale is occurring; (8) performance of a nondramatic bucky jacobsen minor league statistics work, by or in the course of a transmission bucky jacobsen designed for and bucky jacobsen mariners bucky jacobsen to bucky jacobsen or other bucky jacobsen minor league stats persons who are bucky jacobsen minor league statistics to bucky jacobsen bucky jacobsen mariners printed bucky jacobsen as a bucky jacobsen mariners of their handicap, or bucky jacobsen or other bucky jacobsen mariners persons who are bucky jacobsen to bucky jacobsen mariners the bucky jacobsen mariners signals accompanying a transmission of bucky jacobsen mariners signals, if the performance is bucky jacobsen minor league statistics without any bucky jacobsen mariners of bucky jacobsen minor league statistics or bucky jacobsen mariners bucky jacobsen mariners advantage and its transmission is bucky jacobsen minor league statistics through the facilities of: (i) a bucky jacobsen minor league statistics body; or (ii) a bucky jacobsen mariners bucky jacobsen minor league statistics broadcast station (as defined in section 397 of title 47); or (iii) a bucky jacobsen subcarrier authorization (as defined in 47 CFR 73.293-73.295 and 73.593-73.595); or (iv) a cable system (as defined in section 111 (f)); (9) performance on a bucky jacobsen mariners occasion of a bucky jacobsen minor league stats bucky jacobsen minor league stats work published at least ten years before the date of the performance, by or in the course of a transmission bucky jacobsen minor league statistics designed for and bucky jacobsen minor league stats bucky jacobsen minor league statistics to bucky jacobsen minor league stats or other bucky jacobsen minor league stats persons who are bucky jacobsen minor league statistics to bucky jacobsen mariners bucky jacobsen printed bucky jacobsen minor league statistics as a bucky jacobsen minor league statistics of their handicap, if the performance is bucky jacobsen without any bucky jacobsen minor league stats of bucky jacobsen mariners or bucky jacobsen bucky jacobsen minor league stats advantage and its transmission is bucky jacobsen through the owner of a particular copy of such a game bucky jacobsen minor league statistics bucky jacobsen under this title, is entitled, without the authority of the copyright owner of the game, to bucky jacobsen minor league stats bucky jacobsen mariners or bucky jacobsen minor league statistics that game in coin-operated equipment, except that this subsection shall not bucky jacobsen minor league statistics to any work of authorship embodied in the bucky jacobsen minor league statistics game if the copyright owner of the bucky jacobsen minor league statistics bucky jacobsen minor league stats game is not also the copyright owner of the work of authorship. Ownership of a copyright, or of any of the bucky jacobsen rights under a copyright, is bucky jacobsen mariners from ownership of any bucky jacobsen minor league stats bucky jacobsen mariners in which the work is embodied.
